Sample Sales Agreement - Pet

IT IS ACCEPTED AND AGREED THAT _________________________________________ has purchased a pet Poodle (male or female), Registration No. (or Litter Registration No.)________________________, from __________________________________________ for the sum of $_____________, and under the following conditions:

 

  1. This dog shall not be used for breeding. This dog is represented as a healthy, pet quality animal of proper general character and good temperament, but not of sufficient conformation as per the breed standard (as approved by the American Kennel Club and the Poodle Club of America) to justify his or her use for breeding by the seller.
  2. This dog’s health is guaranteed for 48 hours against communicable diseases.
  3. The seller guarantees this dog to be free from any inherited disease which impairs long life, good health, and full function as a pet. If such an inherited defect should occur, and be diagnosed in writing by a Board-Certified veterinary specialist, the seller agrees to replace this dog with a puppy of similar quality, or refund the purchase price upon the return of the originally-purchased dog.
  4. Unless this agreement is voided and replaced by another upon reconsideration of this dog’s eligibility for breeding, this dog shall be spayed or neutered (depending on sex) by the age of 2-1/2 years (recent research suggests it is advantageous to a dog’s health to delay spaying or neutering until 2 years of age so that the joints, bones and muscles will have time to mature). The full pedigree of this dog will be furnished to the buyer, but the registration papers will be withheld until evidence of spaying or neutering is provided to the seller. Upon proof of spaying or neutering, registration papers will be provided to the buyer.
  5. If at any time the buyer named above wishes to sell or place this pet dog, they will first offer it for sale or re-homing to the seller or to a designated and agreed-upon third party.
  6. This dog will not be sold to a dog dealer/broker, pet shop, agent of either, or to anyone who does not sign an agreement precluding such sale or re-homing of this dog. The name and address of any new owner will be provided to the breeder, together with a copy of the above-mentioned sales agreement.
  7. This dog will be maintained in an adequate enclosed area, or on leash, and not allowed to roam at will.
  8. Between the ages of two and three years, the buyer will obtain the following health clearances for the dog and report the results to the breeder: Hip x-rays, OFA eye exam; vWD DNA test (unless the dog is vWD clear by parentage); thyroid test; Addison’s test; and a sebaceous adenitis skin punch biopsy. Further eye exams and skin biopsy tests at 2-year intervals will be done at the breeder’s request and cost.
  9. This dog will be taken to and trained in at least one 8-week basic obedience course prior to the age of two.
